Conditions on permitting imports from Mainland China

According to Item 1 of Paragraph 1 of Article 7, Paragraph 1 of Article 8 and Item 1 of Paragraph 1 of Article 9 of the “Regulations Governing Permission of Trade Between Taiwan Area and Mainland Area”, goods originated from China, if they satisfy the conditions as, “not endanger national security and not have any serious negative impact on related domestic industries”, can be imported after being announced by the Ministry of Economic Affairs (MOEA), R.O.C.

Regulations on commodities imported from Mainland China

The regulations on commodities imported from China is regulated by the “Classification of Import and Export Commodities of the Republic of China” and the “Consolidated List of Conditional Import Items of Mainland China Origin and Regulations Governing Import of Mainland China Origin Commodities”.  Items marked “MW0” in the “Import Regulations” column of the “Classification of Import & Export Commodities of the ROC” are not permitted for import; items marked “MP1” are conditionally permitted for import; other items marked neither “MW0” nor “MP1” are permitted for import.

The commodities on “Consolidated List of Conditional Import Items of Mainland China Origin and Regulations Governing Import of Mainland China Origin Commodities”  include

(a) Items whose CCC code ends with “EX” can only be imported if they conform to the specified Chinese and English names and descriptions in the list.

(b) Items which have “MXX” such asM13,M78,M79marked in the “Special Regulation” column require Import Permit issued by the Bureau of Foreign Trade (BOFT), MOEA.

The relevant Special Regulation concerning the importation of textiles

M13」:Commodities that conform to the following regulations are permitted for import:(1)Textiles for which application has been made to BOFT to have processed in Mainland China, and that will be re-shipped to the US, the EU, Canada, Brazil, or Turkey after being imported into Taiwan, and for which the main production procedures are carried out in Taiwan and meet the "Standards for Determining Main Production Procedures for Textiles Exported to Particular Areas".(2)Raw materials for textiles or semi-finished garments shipped to Mainland China for processing should be in accordance with the "Regulations Permitting Trade between Taiwan Area and Mainland Area" and the words "Chinese Mainland" should be clearly written as the country of destination on the export permit.

 

M78」:Importation must be done in accordance with the "Conditions for applying to import garments consigned to Mainland China for processing" announced by the MOEA.

M79」:Commodities that conform to M13 or M78 above are permitted for import.

Regulations on exemption from import permits for small quantities of Mainland Chinese commodities:

1. Small quantities of products of Mainland Chinese origin belong to one of the following commodities, CIF price under NT 32,000, and less than 24 pieces/units of each item (if cannot be itemized by piece/unit, than item should be 40 kg or less), said good/article does not require an import license and does not need to conform to the rules laid out under the MXX standard.:

a. They are commodities that the MOEA has announced as being not permitted for import from the Mainland.

b. They are commodities announced by the MOEA as permitted for import from the Mainland but have been marked “MXX”.

2. The total amount of CIF is calculated based on the same Import Customs Declaration, and indicated items are classified by serial number. If a serial number does not exist, then Customs will use the aforementioned conditions regarding CIF price and pieces/units to determine if permission for import without an import license can be granted.  However, whether a serial number exists or not, the indicated item cannot be calculated based on its size and color.

Guidelines for the Labeling of Origin for Specific Imported Textiles

Textile products which fall within CCC Chapters 6162 and towel products which fall within CCC 6302.60.00.00-06302.91.00.00-3 and 9404.90.10.00-3quilts, 9404.90.20.00-1 bedspreads (bed covers)shall be labeled with their correct country of origin, if hosiery commodities classified under section 6115 have not been labeled with their correct country of origin, the commodities can be labeled with hang tagscards or small containers(per pair), which are marked with of "country of origin", aforementioned products without labeling shall be prohibited to import to this country (regulation exempted from country-of-origin labeling and other details can be found at BOFT website)

 

 

 

BThe Procedure of Application for Prohibited Goods from Mainland China

The goods items marked “MW0” are not permitted to import.  However, if an enterprise has the need to import the “MW0” goods on the reasons that there is no production in Taiwan, or for special using purpose, or in minimum quantity, the enterprise can apply in special case to Bureau of Foreign Trade stating the reason.
